Restaurant Appeal Succeeds on Newland Avenue , Hull

An  appeal against Hull City Council’s refusal to permit  the  use of former estate agency premises at 160 Newland Avenue as a restaurant has succeeded.  The inspector’s decision released 4th March states that the use of the premises for food and drink purposes is in accordance with planning policy in the Hull City Plan. Such establishments within shopping centres provide a diversity of interest and function for the community and maintain the life of centres in the evening.

The Council were concerned that the proposed use would lead to non retail uses and yet the inspector pointed out that the premises had previously been used by an estate agent, which is a non retail use.  As such there will be no change in the proportion of retail to non retail uses in permitting the restaurant use .

Concerns at car parking were dismissed reflecting the availability of unrestricted parking on Newland Avenue after 6 pm when many retail businesses would be closed.  It was also considered that permitting a restaurant would not add to noise levels or loss of amenity reflecting existing activity on Newland Avenue.  Neither was there any firm evidence to link problems of anti social behaviour with a restaurant use.  Various conditions will be imposed in the approval including customer opening hours between 11 am and 11.30 pm.
